1. Who we are
This store is operated by Bryan Garzón, tax identification number Y9059520H, with registered address at Calle Tomás Meabe 15, 28019, Madrid-Spain ("DiscoPray", "we", "us"). You can reach us at discopray.support@proton.me.
These Terms of Service govern your access to and use of discopray.store and any purchase you make through it (the "Services"). By using the site or placing an order, you accept these Terms. If you do not accept them, do not use the Services.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering you confirm that you meet this requirement and that the information you provide is accurate and complete.
3. Products
DiscoPray sells a magnetic mini record player and sets of 9 NFC discs with original artwork, sold as made-to-order collections. Products are described and photographed as accurately as possible. Colours may vary slightly between screens, and artwork or components may be adjusted for reasons of availability or quality without prior notice, provided the substance of the product is unchanged.
No music is preloaded. DiscoPray does not supply, license or distribute any music. The player reads audio you load yourself. After purchase we email you a guide explaining how to link your own audio files to each disc. You are solely responsible for holding the necessary rights to any content you use with the product.
4. Orders and acceptance
Your order is an offer to purchase. A confirmation email acknowledges receipt of that offer; the contract is formed when we accept the order and begin production. We may refuse or cancel an order at our discretion, including where we suspect fraud, where the product is unavailable, or where a price or description was published in error. If we cancel an accepted order, we refund you in full.
5. Prices and payment
All prices are shown in US dollars (USD) and exclude any import duties or taxes that may apply in the destination country, which are the responsibility of the recipient. Prices may change at any time; changes do not affect orders already accepted. Payment is processed by Shopify Payments and the payment providers enabled at checkout. We do not store your full card details.
6. Shipping
Production and delivery times, destinations, costs and shipping protection are set out in our Shipping Policy, which forms part of these Terms. All timelines are estimates, not guaranteed delivery dates.
7. Warranty, refunds and returns
Because every unit is made to order, we do not accept returns for change of mind. Every DiscoPray is covered by a 30-Day Warranty: if it arrives damaged, arrives faulty, stops working within 30 days of delivery, is not the item you ordered, or never arrives, we replace it free of charge or refund you in full. Full conditions and the claim procedure are set out in our Refund Policy, which forms part of these Terms.
8. Acceptable use
You agree not to use the Services for any unlawful purpose, not to attempt to gain unauthorised access to any part of the site, not to interfere with its operation, and not to copy, scrape, resell or exploit any part of the Services without our written permission.
9. Intellectual property
All content on this site — including the DiscoPray name, logo, disc artwork, product photography, copy and page design — is owned by us or licensed to us and is protected by intellectual property law. You may not reproduce, distribute or create derivative works from it without our written consent.
10. User submissions
If you send us reviews, photos, comments or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content in connection with the Services and our marketing. You confirm that you own the content and that it does not infringe anyone else's rights. We may remove any submission at our discretion.
11. Third-party links and services
The Services may link to or rely on third-party sites and providers. We are not responsible for their content, policies or practices. Your use of a third-party service is governed by that party's own terms.
12. Disclaimer of warranties
Except as expressly stated in these Terms, in our Refund Policy and 30-Day Warranty, or as required by the mandatory consumer protection laws that apply to you, the Services and products are provided "as is" and "as available", without warranties of any kind, whether express or implied.
13. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to your purchase is limited to the amount you paid for the order concerned. We are not liable for indirect, incidental or consequential losses, including loss of profit or loss of data. Nothing in these Terms excludes liability for death, personal injury or fraud, or any liability that cannot lawfully be excluded.
14. Indemnity
You agree to indemnify and hold us harmless from any claim arising out of your breach of these Terms or your unlawful use of the Services.
15. Force majeure
We are not liable for any delay or failure to perform caused by events outside our reasonable control, including carrier disruption, customs delays, natural events, strikes, or failures of supply.
16. Privacy
Our handling of personal data is described in our Privacy Policy.
17. Changes to these Terms
We may update these Terms at any time. The version published on this page at the moment you place an order is the version that applies to that order.
18. Governing law
These Terms are governed by the laws of Spain. Where you are a consumer, you also benefit from the mandatory protections of the law of your country of residence, and you may bring proceedings in the courts of that country. Consumers resident in the European Union may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
